What is mediation? Broadly put, it is an alternative dispute resolution process in which a neutral third party (the mediator) tries to facilitate a settlement. There need not be litigation for the parties to agree to mediate, and the process itself is not binding on the parties. They must consent to the terms of any settlement. A typical mediation begins with a joint session with the mediator in which the ground rules on confidentiality are set.
